A person who enters these premises or takes part in any Event or online services by Warrior Performance will be bound by these terms and conditions as varied from time to time as well as the Specific Terms and Conditions for that Event, Please read these terms and conditions as well as the Specific Terms and Conditions for that Event carefully.
To the extent of any inconsistency, the Specific Terms and Conditions for a Event will prevail over these terms and conditions.
WP reserves the right to vary these terms and conditions at any time and without notice. Please check these terms and conditions on the website or at the venue at regular intervals for any changes.
Conditions of Entry
Management reserves right to inspect bags on entry and exit, and to refuse entry or remove guests for vandalism, stealing, offensive behaviour, failure to properly supervise persons under your care, failure to follow safety instructions or failure to comply with any condition of entry. You should consider this participation an exercise in good judgment and act in a responsible manner while using the facility.
Intellectual Property
Entrants grant to WP an irrevocable, perpetual non-exclusive royalty free license to film, download, upload, print, display, perform, reverse engineer, modify, adapt, copy, reproduce, transmit, disseminate and publish any images or material obtained on the premises or at any event run or sponsored by WP
Limitation on Liability
WP takes all reasonable steps to provide you with a safe and enjoyable experience. However WP will not be liable for any person in respect the loss of life or personal injury to, any person, whether that loss, damage or personal injury is caused by any person’s negligence (including the negligence of WP) or otherwise. This exclusion of liability does not apply to liability which cannot by law be contracted out of. WP will have no liability whatsoever for any loss of moneys, wages, profits or any other incidental, consequential or indirect loss.
No Waiver
No granting of time indulgence or failure to enforce a provision of these terms and conditions shall constitute a waiver by WP of the same.
Privacy
WP collects personal information to provide and market its products and services. That information may be disclosed to WP’s contractors who assist it with these activities. WP’s Privacy Policy contains information about how an individual may access or correct information WP holds about the individual, how complaints about a breach of privacy can be made to WP and how such complaints will be dealt with. Any Entrant who does not consent to WP using the Entrant’s personal information to market products and services should notify – info@warriorperformance.com.au
Release and Indemnity
Each Entrant releases and indemnifies WP from and against any liability arising from:
Any breach of these terms and conditions or specific terms and conditions for the Event by the Entrant, any use or misuse of prizes by the Entrant.
Any other conduct by the Entrant which entitles WP to terminate the membership or participation in any event.
Definitions
In these terms and conditions unless the context otherwise requires:
WP means Warrior Perforamnce, and is not limited to but may include its coaches, staff or any other company or sponsor that may be assisting on Warrior Performances behalf.
Event means any promotion, competition or any other event that is promoted by WP either on or off it’s premises.
Online services may include but are not limited to; coaching advice, articles, posts, videos. Via email, Facebook, instagram, linkedin, youtube, vimeo, etc.
Conditions for the Event or Specific Terms and Conditions means in respect to an event where there may be extra terms set by attached bodies, companies, hosts or sponsors, that can be found by contacting them directly.
Entrant means an person who steps foot with in the premises, is involved with online or who takes part in a event in any capacitity in accordance with these terms and conditions.
Intellectual Property and Intellectual Property Rights includes property and rights in connection with copyright (including future copyright and rights in the nature of or analogous to copyright), trade mark, service mark, design, inventions (including patents), trade, business or company names, or other proprietary rights, or any rights to registration of such rights (including all renewals and extensions).
Prize means in respect of an Event, the prize, award or other benefit to be awarded to the winner of the Competition as set out in the Specific Terms and Conditions for the Event.
Interpretation
In these terms and conditions, and in the Specific terms and Conditions for a Event, unless the context otherwise requires:
Headings do not affect interpretation.
Singular includes plural and plural includes singular.
Words of one gender include any gender.
A reference to a party includes its executors, administrators, successors and permitted assigns.
A reference to a person includes a partnership, corporation, association, government body and any other entity.
A provision is not to be construed against a person because that person prepared it;
An unenforceable provision or part of a provision may be severed, and the remainder of the terms and conditions continues in force, unless this would materially change the intended effect of those terms and conditions.
The meaning of general words is not limited by specific examples introduced by ‘including’, ‘for example’ or similar expressions.
